This is an appeal from a judgment dismissing the defendant's second amended petition filed pursuant to the provisions of the Post-Conviction Hearing Act (Ill. Rev. Stat. 1969, ch. 38, par. 122-1 et seq.), wherein he alleged various violations of his constitutional rights. The defendant, Otis McNeil, was indicted in the circuit court of Cook County for the armed robbery of a fur salon. He was found guilty by a jury and was sentenced to a term of not less than 15 nor more than 25 years in the State penitentiary. His conviction was affirmed by the appellate court (99 Ill. App.2d 273), and thereafter he filed a pro se habeas corpus petition in the U.S. District Court, which was dismissed because he had failed to exhaust his State remedies.
